1.1  Sitekee Pty Ltd trading as Animail (ABN 71 641 888 726)  (referred to throughout as "we", "us", or "our") is committed to protecting the privacy of our customers.

1.2 This Privacy Policy sets out how we collect, hold, use and disclosure personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) as set out in that Act.

1.3  “Personal Information” is information or an opinion about

an identified individual, or an individual who is reasonably identifiable, whether the information is true or not, and whether recorded in a material form or not.


2. Collection of Personal Information  


2.1 We may collect your personal information from you in a number of ways including when you interact with us electronically or in person, when you access our website or our Animail mobile application (App) and when we provide our products and services to you.

2.2 The type of personal information we collect includes:

  • Your full name: to personalise our communications with you and to create and manage your account.
  • Your email address: to communicate with you about your orders, and promotions. We may also use your email address to send you marketing communications that we believe may be of interest to you.
  • Your contact details: We may collect your phone number, email address, or other contact details to facilitate the delivery of products and services to you.
  • Usage Information: We may collect information about how you use our website, App, or services, such as the pages you visit or the features you use.

2.3  We may also collect personal information that you have entered into our App. This personal information may include but is not limited to:

  • Your name;
  • Your address;
  • Your phone number;
  • Your email address;
  • Your pet’s name;
  • Your username to sign into the App;
  • Information about your pet, such as medical information; and
  • Information in any documentation in relation to your pet.

2.4 We will also collect personal information of any “authorised contact” that is entered into our App. This personal information may include but is not limited to:

  • The authorised contact’s name;
  • The authorised contact’s address;
  • The authorised contact’s phone number; and
  • The authorised contact’s email address.

2.5 Where you provide personal information of another person in the App to be an “authorised contact”, you confirm that they are over 18 years of age and that you have notified them of this Privacy Policy and that they have agreed to the collection, processing and disclosure of their personal information as set out in this Privacy Policy. You must also inform them that they may have rights to access and correct their personal information. 

2.6 We may also collect personal information about you from third-party sources, such as social media platforms, if you choose to connect with us through those channels. If we do, we will protect it as set out in this Privacy Policy.

2.7 We may collect payment information from you, such as your credit card or banking details to process payments for products and services that you purchase from us in person. All payments for our products and services that are purchased online are processed by third party service providers engaged by us, such as Amazon Pay. Our website has links to the third party service providers that we use.

2.8 By subscribing to the App via the App Store or the Google Play Store App, you consent to each of these apps having access to your personal information such as your credit card and banking details to process your payment to subscribe to the App. If you require information about how the App Store or the Google Play App Store treats personal information, please refer to the privacy policy for each of these apps.


3.  How we use Personal Information


3.1 We will collect and use your personal information for our business activities and functions, which may include the following:

  • To provide our products and services to you: We use your personal information to provide you with access to our products and services and to communicate with you about our products and services.
  • To communicate with you: We use your personal information to communicate with you about any products and services requested. We may also use your personal information to send you marketing communications that we believe may be of interest to you.
  • To improve our services: We use your personal information to analyse how our website, App, and services are used, and to improve the overall user experience.

5. Disclosure of Personal Information


5.1 We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents or third party service providers insofar as reasonably necessary for the purposes set out in this Policy.

5.2 We may disclose personal information to government or regulatory bodies or enforcement agencies if we are required to do so by law or if we believe such action is necessary to prevent fraud or cyber-crime or to protect public safety.

5.3 We require our service providers to comply with the APPs and take reasonable steps to ensure that your personal information is protected.

5.4 We do not disclose or transfer your personal information overseas or into the “cloud” outside Australia. All personal information collected by us is stored and processed in Australia. The third party service providers we use to process payments may conduct part of their business overseas so your personal information may be processed off-shore. We take reasonable steps to ensure that these service providers do not use your personal information in a manner inconsistent with the Apps.


6. The App


6.1 When you use our App we may collect certain information such as mobile unique device ID, the IP address of your mobile device, mobile operating system, the type of mobile internet browsers you use, and information about the way you use the App. This information is used to analyse how people use our App so that we can improve our service.

6.2 The App may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the App.

6.3 It is within the sole discretion of the purchaser of the App to determine the extent to which they wish to disclose their personal information, including information about their pet to a third party should they activate the App. This personal information includes any such information that is entered into the App as text or for the purposes of being transmitted as a recorded voicemail message or any documentation that is uploaded to the App. The disclosure of your personal information to a third party that has activated the App is at your own risk.

6.4 The App uses GPS technology (or other similar technology) to determine the location of your pet when the pet tag is tapped. However, information in the App regarding the location of your lost pet may be inaccurate or may not be provided at all.


7. Opt out right of the App


7.1 You can stop all collection of information by the App by uninstalling the App. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace.


8. Use of Personal Information for Direct Marketing


8.1 If you provide us with your personal information and you consent to receiving direct marketing communications from us, you authorise us to send you promotional emails about our products and services that we believe may be of interest to you.

8.2  You have the right to elect not to receive the receipt of direct marketing communications. Any electronic message that we send will identify us as the sender and will include our contact details and an unsubscribe facility. If you do not wish to receive marketing communications from us, please use the unsubscribe facility provided in the communication sent by us.


9.  Access and Correction of Personal Information


9.1 You have the right to access the personal information we hold about you and to request that it be corrected if it is inaccurate, incomplete, or out of date. To request access or correction, please contact our Privacy Officer by email at info@animail.pet.


10. Cookies


10.1 We use cookies to enhance your experience on our website and App. Cookies are small text files that are placed on your device when you visit our website or use our App. We use cookies to:

  • Remember your preferences and settings;
  • Analyse how our website and App are used;
  • Personalise our communications with you; and
  • Collect statistical information.

10.2  You can choose to disable cookies in your browser settings. However, please note that disabling cookies may affect your experience on our website and App.

12. Queries and Complaints about Privacy

12.2 All complaints are to be submitted in writing. Please provide as much detail as possible so that we may resolve it in an efficient manner.

12.3 You may choose to communicate with us anonymously or use a pseudonym when making a complaint or inquiry in relation to this Privacy Policy, the APPs or your privacy rights. However, we may require you to identify yourself if required by law or if it is impracticable for us to deal with your matter.

12.4 Your complaint will be investigated and responded to within 30 days of receipt unless you are advised that the matter is more complex and the investigation may take longer.

12.5 We will investigate and attempt to resolve any alleged breach of privacy internally. However, if your complaint is not resolved to your satisfaction, you may choose to take your complaint to the Office of the Australian Information Commissioner by vising their website at:  https://www.oaic.gov.au/privacy/privacy-complaints.


13. Changes to Our Privacy Policy


13.1 We may update our Privacy Policy from time to time. Any change, modification or update to this Privacy Policy will be effective immediately upon posting. We will notify you of any changes by posting the updated Privacy Policy on our website.
